Village and its residents are suing railways and various government entities in two lawsuit
The losses are listed as real property, personal property, housing, business income, rental income, costs of alternative accommodation, costs of emergency and temporary repairs, professional fees, reconstruction costs, vehicle losses as well as the costs of inconvenience and hardship of losing their homes and businesses and pain and suffering.
“The fire was caused by the heat and/or sparks and/or diesel exhaust particulate emanating from a train or trains” owned by CP or CN Rail, the lawsuit alleges. And it alleged the defendants failed to order a stop to running the trains despite a drought and record-setting temperatures that rose to 49.6 degrees Celsius the day before the fire.Advertisement 5Devastated buildings in Lytton on March 18, 2022.The second new lawsuit was filed by Lytton against the Municipal Insurance Association of B.C.
That claim says the railways failed to ensure the train’s braking and other systems were safe, that they didn’t use reasonable fire prevention methods and failed to watch for smoke or fire along the tracks. None of those allegations have been proven in court and CN, CP and Transport Canada have not filed a response to the claim.A Transportation Safety Board investigation did not find evidence that railway operations sparked the Lytton wildfire.Article content
Transport Canada was accused of breaching its duty to the community by failing to order CP and CN to halt trains during the heat wave.
