A viral photo that was taken in a Kingston hospital and shared to show the love of 2SLGBTQ+ families has led to a court battle in Italy.
As Milo came into the world, fathers Rosario Barone and Frank Nelson cried. They hugged. Overwhelmed with emotion, they barely noticed Foster as she snapped the moment of immense joy. The Gananoque native knew what she had was beauty captured in an instant.Shared on social media during Pride month, the photo would go viral around the world.
When Foster returned, her phone had blown up. The photo, which was posted over Pride weekend in Toronto, had gone viral around the world. There were both positive and negative comments. She deleted the negative ones the best she could, but they were overwhelming. The trio decided together to sue the political party for using the photo. They chose lawyers from the LGBTQ+ community. Nelson and Barone sued for defamation of character while Foster believed she was suing because the party used her photo without permission, essentially copyright infringement.
She’s reached out to her lawyers to ask how to pay the penalty but had not heard back until she emailed them again on Thursday night. They replied via email early Friday morning, angry she was sharing her story of the loss.Article content
