When an upside-down U.S. flag flew over the home of Supreme Court Justice Samuel Alito in January 2021, it was largely seen in connection with the false claim by then-President Donald Trump’s supporters that the 2020 election had been marred by fraud.
FILE - Supreme Court Justice Samuel Alito Jr., left, and his wife Martha-Ann Alito, pay their respects at the casket of Reverend Billy Graham at the Rotunda of the U.S. Capitol Building in Washington, Feb. 28, 2018. An upside-down American flag was displayed outside of Alito's home Jan. 17, 2021, days after former President Donald Trump supporters stormed the U.S. Capitol, The New York Times reports. It's a symbol associated with Trump's false claims of election fraud.
While the Supreme Court long went without its own specific code of ethics, an institutional reputation of staying above the political fray has long helped bolster its relatively high levels of public trust. But in the wake of the 2022 decision overturning a nationwide right to abortion — an opinion that was leaked before its release — public trust sank to its lowest level in 50 years.
The American flag is not supposed to be flown upside down except as a signal of dire distress or extreme danger, according to the U.S. Flag Code. That significance has made it into a protest symbol on both the left and the right for decades. It took off as a symbol of Trump’s “Stop the Steal” campaign as he spread false claims that the election he lost to Biden had been stolen.
