Last October, a jury rejected the Crown’s theory that Andrew Douglas killed Michael Lewis for humiliating his slain brother, the Toronto rapper Smoke Dawg.
is now wanted for an April shooting about two kilometres from where he shot Michael Lewis six times in broad daylight during a memorial barbeque.
At trial, Douglas testified that Lewis brought the firearm and that he was acting in self-defence. The Crown urged jurors to reject that scenario given that Douglas was only in the park for less than six minutes, and that he shot Lewis six times in the head. The sole issue at that judge-alone trial was identification; the judge believed the evidence of a co-accused that Douglas was one of two men he had driven to the scene of the robbery. That evidence was also corroborated by Douglas’s DNA, which was found on clothing in the vehicle as well as a wallet that had an ultrasound of his child. Douglas’s appeal lawyer intended to argue that the trial judge made several errors, including in admitting the co-accused’s testimony.
“My plan is to stay out of trouble and secure employment. I want to get back to work as soon as possible so I can support my two children,” Douglas wrote in an affidavit filed last December with his bail application.When Douglas is arrested on the latest charges, he’ll have to serve the rest of his sentence.
