The Supreme Court has ruled 6-3 that New York state’s concealed carry law is unconstitutional, an outcome that is expected to make it easier for Americans to carry guns.

, 25 states require a permit in order to carry concealed weapons in public. Eight states — including New York — and the District of Columbia have what are known as “may issue” concealed carry laws. These laws give authorities wide discretion to deny concealed carry permits, for instance if someone has not demonstrated a strong need for carrying a concealed weapon in public.

Seventeen states have “shall issue” concealed carry laws, offering authorities little to no discretion to deny permits those who meet basic qualifications. the remaining 25 states allow people to carry concealed weapons in most public spaces without any permit, background check, or safety training.from the court asserts that New York’s law violates the Constitution “because New York issues public-carry licenses only when an applicant demonstrates a special need for self-defense.” Thomas writes that the government cannot justify a gun regulation simply because it “promotes an important interest.

Justice Stephen Breyer wrote the dissenting opinion, which Justices Sonia Sotomayor and Elena Kagan signed onto. In it, Breyer devotes a significant amount of space to detailing the rise of gun violence in America, providing a long list of recent mass shootings that have occurred in Philadelphia, Pennsylvania, Uvalde, Texas, Buffalo, New York, and more.
