Texas Senate new voting law would harm democracy

Ensuring elections are secure is important. But when voting laws are so stringent they strike fear in the heart of the electorate, that isn’t securing democracy. It’s undermining it., a high-priority piece of legislation authored by Sen. Bryan Hughes, R-Mineola, with the full support of Lt. Gov. Dan Patrick.

The bill would roll back a 2021 law that made voting illegally a Class A misdemeanor instead of a felony. But it would also change the standard under which a person could be prosecuted.Under the proposed law, the prosecutor would have to show only that the person was aware of a circumstance that would make him ineligible to vote. For example, if the person knew he was an immigrant, but was unaware that immigrants cannot vote legally, the person could still be prosecuted.

The bill’s more likely effect is to suppress the votes of people who are eligible but who might fear the heavy hand of the law. Those people are most likely to come from lower-income and minority communities.
