The unanimous 42-page decision released Monday provides guidelines for determining whether a sexual assault victim’s address can be held from discovery.

Oscar Ramirez, 27, of North Bergen, has been charged with sexually assaulting a woman in the Grove Church Cemetery on Oct. 25, 2019.The state Supreme Court, ruling in a victim’s privacy rights case that involved a North Bergen rape, established a “framework of procedures” that balances both the rights of the victim to feel safe and the rights of the accused to a fair trial.

the motion judge’s ruling, saying that “to permit defense investigators to access the victim’s home, against her expressed instructions,” would violate her right to privacy. In the North Bergen case, the woman said in the protective order application she is afraid Ramirez or someone close to him would be able to locate her. She also said she doesn’t want to speak to the defense before trial about the case, including in-person, by telephone or by video conference.in the Grove Church Cemetery. She was walking home from her job as a waitress when she was dragged into the cemetery property and raped, authorities said.
