Harris County Institute of Forensic Sciences identified the boyPedro Alberto Hernandez, 52, has been charged with murder and driving while intoxicated in connection with the deadly crash outside a washateria near Bissonnet Street and Leawood Boulevard, court records show. He showed up for his Tuesday court appearance with a black eye.
The grandfather yelled at the driver, who stopped and ran over the boy again, court documents state, and then once more after the grandfather yelled at him a second time. The grandfather pulled him from his SUV and pinned him against the hood of the car, according to records. Several other witnesses helped detain him while waiting for police to arrive, prosecutors said.
The suspect's delayed court appearance followed the inability Monday morning to find Hernandez a Spanish-speaking lawyer. Defense attorney Daniel Werlinger was appointed to the case Tuesday and expressed concern for his client’s apparent head injury. Judge Natalia Cornelio raised Hernandez’s bond to a combined $950,000 on both charges – an amount shy of what prosecutors wanted but more than Werlinger believed sufficient.
