Three Oak Lawn police officers accused in a federal lawsuit of pummeling a then 17-year-old during a July 2022 arrest are asking for an indefinite stay in the civil case until the conclusion of criminal proceedings.
Three Oak Lawn police officers accused in a federal lawsuit of pummeling a then 17-year-old during a July 2022 arrest are asking for an indefinite stay in the civil case until the conclusion of “multiple criminal proceedings,” including one involving an indictment of one of the officers, according to court filings.
Collins and Hollingsworth have not been charged with criminal misconduct, and their attorneys said it is that uncertainty about potential charges that is, in part, prompting the stay request. In asking for the stay, the village said in an April 21 filing that with O’Donnell facing indictment, the village “cannot practically and purposefully participate in the underlying discovery without the participation of the officer.”
The village is in “the unfavorable position of lacking the best and most accurate evidence related to the underlying claims, the testimony of the three officers,” the filing says., which alleges the officers “engaged in extreme and outrageous conduct” in connection with the arrest.
