🔴 Thousands of people infected with Hepatitis C and HIV during the worst scandal in NHS history will finally receive compensation

More people who lost loved ones during the “biggest treatment disaster in the NHS” should be entitled to compensation, the chair of the Infected Blood Inquiry has recommended.

The amount of compensation will depend on the type of infection and the impact it had, defined by an independent clinical panel. Publishing the Inquiry’s second interim report on Wednesday morning, setting out the framework for compensation to the victims, Sir Brian said the range of awards for the impact should be determined by an independent legal panel and consistent with what would be awarded in common law personal injury litigation.

The Government has recognised that wrongs were done and that compensation should follow, and made interim payments of £100,000 in October last year. Ministers said in January 2023 interim compensation payments of about £400m showed it accepts its “moral responsibility” to help victims. “It is a fact that around 380 children with bleeding disorders were infected with HIV. Some of them died in childhood. But their parents have never received compensation. Children who were orphaned as a result of infections transmitted by blood transfusions and blood products and have never had their losses recognised. It is time to put this right.”

In 2017, then Prime Minister Theresa May ordered the public inquiry into what she called an “appalling tragedy which should simply never have happened”. The Department of Health and Social Care’s written closing submissions to the inquiry, dated December 16 last year, said the department accepted that “things happened that should not have happened” and that no statements made on its behalf should detract from its “unreserved” apology.
