Medical examiner can't determine cause of death, manslaughter trial told yyc

But Crown lawyer Tom Buglas conceded a major issue in the trial of Samuel Kong Liong will be the cause of death of his alleged victim, Mayiel Deng Kiir.Buglas told Justice Paul Mason that medical examiner Dr. Akmal Coetzee-Khan wasn’t able to determine either the manner of Kiir’s death, or the cause.

“You will hear from Dr. Coetzee-Khan … that as the forensic pathologist he cannot find a cause, or manner of death,” the prosecutor said. But Buglas said the Crown’s theory is Liong choked Kiir during an altercation at a northeast Calgary home in the early morning hours of July 24, 2021, leading to the victim’s demise.

“The force used on Mr. Kiir, especially any force that would be consistent with strangulation or choking … was in excess of any force required as part of any consensual fight, or as part of any self-defence against aggression,” Buglas said.Article contentRecommended from EditorialBuglas also told Mason he will be asking the judge to allow him to call three police statements given by an eyewitness in the home, Rickey Perih, who died of a drug overdose on Dec. 30, 2021.
