At Norman Mailer’s trial for drunkenness and disorderly conduct, he argued the defense himself. NewYorkerArchive

began on Commercial Street, in Provincetown, at about one-ten on the morning of June 9th last. The bars close at one in Provincetown, and Mailer and his pretty brunette wife, Adele, who was acting at the Provincetown Playhouse this summer, were walking home after some pub-crawling.

“Maybe you could and maybe you couldn’t, but you picked the wrong pigeon this time. You cops are used to dealing with people who can’t defend themselves. Well, I’m a writer and I know how to use words, and, boy, I’m going to use them.” The next morning, I joined the Mailers for breakfast. Over coffee, Mailer revealed to his wife that he was going to put her on the stand, explaining that he had said nothing about it earlier, lest she get tensed up. She showed signs of alarm.“Yes, I know, but—”Mailer decided that he and his wife should both dress in sober black for the occasion.

Two short cases first—a bored young man in dungarees who pleaded guilty to dangerous operation of a motor scooter, and a red-eyed, unshaven workingman who pleaded guilty to Drunk & Disorderly, and clowned around a bit, scoring once. The Judge asked him, “Why do you drink?” and he replied, “I like it.”

Mailer rose to cross-examine Chief Marshall. He walked up with a slight swagger—something between the new gun in town and Perry Mason—and his first questions were delivered in a sinister Texas drawl; throughout the hearing, he shifted gears between this accent and his normal one , according to the dramatic voltage he felt was required. This drew a blank.
