A man is suing a Cleveland police officer and the city after two judges found he was either dishonest or reckless during investigations that led to the man's arrests.CLEVELAND, Ohio— A Cleveland man is suing a city police officer after a federal judge threw out his case when she found the officer either lied or was reckless during his investigation.
City officials did not respond to messages seeking comment and typically decline to address newly filed lawsuits. The lawsuit was filed by Ellis’ attorneys, Joseph Scott and Marcus Sidoti. The lawsuit and court records from Ellis’ prior criminal cases say Ellis’ and Yasenchack’s history dates back to a 2019 arrest on charges of drug trafficking.
Cuyahoga County Common Pleas Judge Deborah Turner agreed, and she granted Ellis’ attorneys motion to suppress evidence collected from the traffic stop. County prosecutors dropped charges against Ellis several months later, on May 14, 2020. Yasenchack also didn’t disclose in the search-warrant application that Turner previously found him his testimony in the case “was severely diminished and not credible,” according to court records.
