For the “gratuitous and brutal” murder of trans activist Julie Berman, a Toronto judge sentenced Colin Harnack to life in prison Wednesday with no eligibility for parole for 12 years.
after he said Berman attacked him for stealing crack cocaine from her purse.
“The 12-year period of parole ineligibility does not mean that Mr. Harnack will be released after serving 12 years. It only means that this is when he first becomes eligible for release. Whether he will be released will be up to the Parole Board, and that decision will be based in part on how Mr. Harnack conducts himself between now and then.”in victim impact statements as a “gentle and timid” person who pleaded for greater acceptance of transgender people.
No motive was established for the murder. Crown attorney Heather Keating said at Harnack’s sentencing hearing last month that it was a “significant fact” that Harnack did not know when he first met Berman that she was transgender, and pointed out that the murder happened “shortly after” sexual contact.
“We always trusted and knew that Justice Kelly would find the proper balance that is required in these circumstances and Her Honour did just that,” defence lawyer Nabeel Sheiban told the Star Wednesday. “The parole ineligibility imposed recognized the many facets of this case.” Kelly also noted that he was found guilty of misconduct while in custody, having been found in possession of fentanyl and losing his canteen privileges for two weeks.
