The lawyer for Pacey Dumas is trying to circumvent Alberta's Crown prosecution service and get the Edmonton Police Service officer charged with aggravated assault.

A family that feels Alberta’s justice system failed to do its duty is now pursuing another avenue in their quest to hold to account an Edmonton Police Service officer who kicked a young man in the head, leaving him with life-altering injuries.

“We will hopefully be allowed to present our evidence to a judge and thereafter, the process — which is a path less travelled at this point, to my knowledge — would require the Crown service to decide if they are going to in fact take up the prosecution or if we have other means of applying to the Attorney General to actually prosecute privately. ”Dumas said he’s feeling mixed emotions about getting his day in court.“I don’t know what’s going to happen. That cop should get charged.

Dumas said he was the person with a knife and reached into his pockets or waistband, according to the report, which went on to say the officer told Dumas to take his hands out or he would kick him. Dumas weighed 90 pounds and was already on the ground. ASIRT also noted his proximity to the officer was a result of the officer’s orders.Dumas was rushed to hospital and diagnosed with critical intracranial injuries: a subdural hemorrhage and midline shift.
