for some of the same complaints that have been documented for years by environmental advocates. The environmentalists charge that the TCEQ's rules allow developers to skirt the law and cut the public out of permitting processes, among other things.

Metzger’s group and a number of other environmental advocates believe the Texas Environmental Quality Commission has failed systematically for years at reining in polluters., the groups said companies have released 409,575 pounds of air pollution in 21,769 incidents from September 2016, through August of last year.

Many testified that pollution-heavy industries disproportionately build their plants around low-income communities, which are often predominantly populated by people of color. Several called for a new state office of environmental justice to consider those concerns. Despite that, none have been designated as “chronic” offenders, which could trigger harsher penalties. A number of environmental groups from Harris County chartered a bus to Austin to attend the hearing and testify on Thursday.
