The court official appears to back up claims by a local judge who said some Latino defendants were denied the option of attending virtual court hearings.
said those with Latino-sounding surnames appeared to be treated differently when it came to scheduling their cases, according to a document obtained by NJ Advance Media.
However, under the law, either in-person or over-the-phone interpreters should be available for all in-person or virtual hearings.Millville Municipal Court Judge Jason Witcher in DecemberWitcher alleged court administrators in Millville were requiring Spanish-speaking and Latino defendants to attend in-person court sessions for routine traffic citations and other municipal matters, rather than giving them the option of virtual hearings in his court.
Keith declined Monday to comment on her interview with investigators and referred questions about her statement to the judiciary communications office. Millville Municipal Court Administrator Kimberly Hamlyn did not respond to an email seeking comment.“The leaking of an interview during an investigation is inappropriate,” McAleer said. “We encourage the public to wait until a full investigation has been completed before drawing any conclusions.
Keith said she was told by Hamlyn, Millville’s municipal court administrator, to schedule cases requiring interpreter assistance on Mondays during in-person court sessions because Millville only had an in-person Spanish interpreter two Mondays a month, according to the summary of her interview with investigators.
“It was my observation that cases in Millville were scheduled as a result of the last name,” she said, according to the interview summary. “Cases involving Spanish names had notes to be scheduled for a Monday when the interpreter was available. It also seemed to me like cases that needed an interpreter and were originally scheduled for virtual court were then rescheduled for in-person court.
