USCIS policies under the Trump administration have resulted in much higher denial rates for employers petitioning for H-1B visa holders. continues to deny H-1B petitions at an historically high rate, making it more difficult for international students to work in America and for companies to conduct research and service customers in the United States.

The analysis also found USCIS continues to deny H-1B applications for existing employees at rates far higher than in the past. “In the first two quarters of FY 2019, USCIS adjudicators denied 14% of H-1B petitions for ‘continuing’ employment, compared to denying only 3% of H-1B petitions for continuing employment in FY 2015 ,” according to the National Foundation for American Policy report.

The 27 companies USCIS has identified as the top employers of H-1B visa holders, including well-known companies like Apple and Amazon, all saw an increase in their H-1B denial rates for initial employment in FY 2019 when compared to FY 2015.
