Tuesday's hearing centered on the defense's objection to the state's notice of joinder. Judge Karen Sage granted the defense’s motion of severance, and will not allow the combination of a new misdemeanor assault charge with the manslaughter charge for deputy Johnson. "We don't have to prove anything, we don't have to mount any defense. The burden of proof is on the defense," said O'Connell.
"A high profile media case like this has unique challenges. The lawyers will expect potential jurors to walk in with many of them, potentially having already made up their mind," said Cofer.
