Jan Vanderzwaag, 44, pleaded not guilty to the charges and had a trial in P.E.I. Supreme Court before a 12-person jury and Justice John Mitchell. The trial began on Sept. 11 and ended on Sept. 20 with closing arguments from Vanderzwaag's lawyer Brian Ross and Crown attorney Lisa Goulden. The following day on Sept. 21, Mitchell gave instructions to the jury before they were sent for deliberations. Just before 9 p.m. on Sept. 21, the jury came back with the not guilty verdicts.

The alleged sexual assaults occurred in early July 2001 at a movie night and sleepover at Vanderzwaag's family home in Stratford. Vanderzwaag denied molesting the younger brother. He did admit to performing oral sex on the older brother, but said it was consensual. Vanderzwaag lives in Ontario and is a part-owner and manager of a produce marketing and logistics company. He is originally from the Netherlands but grew up on P.E.I. in Vernon River and Stratford.
