Judge orders election commissioner to reconsider $70K fine against 'kamikaze' UCP leadership candidate abpoli

The investigation found that in September 2017, Callaway asked deputy campaign manager Cameron Davies to meet with Robyn Lore, a friend of Callaway’s who was majority shareholder in a company called Agropyron Enterprises.

The commissioner ultimately found Callaway “took planned and co-ordinated steps to obscure the actual source of the funds furnished to the straw contributors.” The scheme “required careful planning and co-ordination and there was an intent to circumvent or attempt to circumvent a contribution amount limit,” Ashcroft summarized, adding Callaway directly or indirectly solicited or accepted the Agropyron money despite rules against donations from such entities.

“Mr. Callaway had ample time to consider the substantive allegations against him, prepare his response or seek additional time if necessary,” she wrote. “I find that Mr. Callaway was provided with an opportunity to meaningfully respond to those allegations.” While declining to overturn the commissioner’s decision, Ashcroft did agree to quash the commissioner’s finding that Callaway had engaged in “collusion,” finding that part of the law was not in force at the time.
