Delaware Superior Court Judge Eric Davis called the stunning development the"best lawyering" he's ever seen,The jury had just officially been selected and as the court waited to return to begin hearing arguments at 1:30 p.m. ET, a roughly two-and-a-half-hour delay brought speculation that the two sides had reached a settlement.
Members of the legal team representing Dominion Voting Systems leave the Leonard Williams Justice Center where Dominion is suing FOX News in Delaware Superior Court during a lunch break on April 18, 2023 in Wilmington, Delaware.Dominion was suing Fox over allegedly false claims that anchors and guests on the network made about the voting machine company and its role in alleged election fraud in the 2020 presidential election.
Returning to the bench around 4 p.m., Davis announced the news and thanked the jurors, telling them,"Without you, the parties wouldn't have been able to resolve their situation." Shortly before the agreement was reached, Davis had appointed a special master to investigate Fox over its handling of discovery. The judge had criticized the company for not turning over evidence in a timely manner nearly a week earlier.
