An Oakland police detective admitted he doesn’t know who fired the shot that killed 19-year-old Madalyn Sandoval, but police argued that it doesn’t matter.
OAKLAND — Two men who allegedly shot at each other in a 3:30 a.m. incident on an empty Oakland street have both been ordered to stand trial on charges that they murdered a passenger in one of the cars, court records show.
At the hearing, Oakland police Det. Michael Khem testified he didn’t know who fired the fatal shot, didn’t review autopsy photos to look for stippling that may indicate if the bullet was fired at close range, and didn’t know who fired first in the“Whether or not Samuels shot first, Sevilla shot first, we may never actually know. The important part and the important issue is that both men were armed, both men shot, both men shot multiple times, and their actions caused the death of Ms.
Martin Caraves, the attorney representing Sevilla, argued not only that prosecutors had failed to prove who fired the fatal shot, but that they couldn’t prove that Sandoval was killed during the shootout.
