So, why would the DOJ take the chance of bringing the case in a jurisdiction more favorable to Trump and risk drawing a judge who previously appeared to favor Trump with questionable legal rulings? Such a possibility might have given the DOJ—particularly a DOJ led by a former federal court of appeals judge—some pause. Prosecutors may also have been worried that bringing the case in D.C. would lead to time-consuming pre-trial litigation about venue that would play into Trump’s usual delay tactics with every day of delay bringing the case closer to the red zone of the 2024 Presidential race.
