Steinke-Attia said her client is also considering the uncommon step of launching a private criminal prosecution against Todd.Thursday, ASIRT executive director Michael Ewenson said Todd kicked Dumas Dec. 9, 2020, while responding to his mother’s home after a 911 call from a third party claiming a male had a knife at another location.

An independent eyewitness said one of the officers yelled at Dumas then kicked him in the face “as if you’re kicking … a soccer ball.” Dumas’s unconscious body was then handcuffed, until paramedics repeatedly asked police to remove the restraints and rushed him to hospital. Dumas spent nine days in hospital, during which a piece of skull was removed to relieve pressure on his swelling brain. More than a year passed before surgeons installed a metal plate to close the opening.Article content

In a statement Thursday, the ACPS said it opted not to charge Todd — who remains on paid leave — because two prosecutors from the Calgary appeals and specialized prosecutions branch did not believe there was a reasonable likelihood of conviction.ssues adviser and legal counsel, declined to elaborate on why prosecutors did not think a conviction was attainable, given the officers’ own evidence and the presence of two civilian witnesses.
