The Ontario Motor Vehicle Industry Council was established in 1997 to regulate auto retailers and protect consumers who enter into transactions with car dealers. But it has come under scrutiny following a report that found it underperforms.

The Ontario government established OMVIC in 1997 to regulate auto retailers and protect consumers who enter into transactions with new and used car dealers. The organization is predicated on the notion of industry self-regulation, which enables the sector to monitor its dealers’ adherence to legal, financial and ethical standards, rather than rely on government enforcement.

OMVIC also noted that it is restricted in what it can do in some “confrontational interactions” between dealers and consumers, as the Motor Vehicle Dealers Act doesn’t address all such situations. It also can’t adjudicate in complaints involving repair-related issues, it said, since mechanics, service technicians and service representatives are not registered under the Act.

In an email response, OMVIC did not address specific allegations made by Bouchama, but admitted board changes are needed to “enhance consumer protection, and enhance accountability for the sector.” “They never explained what I was getting,” Draven said. “We rely on sales professionals to advise us on these options.” She said the dealer aggressively pushed the rustproofing, but did not make it a “mandatory” option — high-profit add-ons buyers are increasingly forced to pay for these days.“Another dealer pointed out that the electronic module may void the warranty on hybrid models due to all the electrical wiring,” Draven said.

When asked about Draven’s complaint, OMVIC said it cannot comment on specific incidents unless they result in an action, which is then made publicly available on the organization’s website. But the head of OMVIC did address the general situation Draven found herself in. Altman said it took enormous diligence on his part — he counts “70 to 100 email exchanges” — to motivate OMVIC to pursue his case. He believes he was successful partly because of the involvement of MTO.
