, Brooks and her attorney, Bill Bock of Kroger, Gardis and Regas, LLP, in Indianapolis, explained how their lawsuit is a two-step process.

In other words, Brooks and her legal team are hoping the waiver is set aside. If it is, they can continue with a direct lawsuit against USATF. The 41-page complaint asserts: “USATF did not respond to protect the health, safety, and well-being of the female heptathlon competitors, despite being well aware of the extreme risks of proceeding with the women’s heptathlon competition during the hottest part of the hottest day on record in Eugene, Oregon. This conduct by USA Track and Field was unconscionable and in disregard of its duty to prioritize health and safety of its athletes.
