Mark David Johnson filed a motion last week through his attorneys asking Judge Burt Smithart to dismiss the felonies.

In October 2022, a Houston County grand jury indicted Johnson after a News4 investigation revealed a female habitual drug offender claimed Johnson engaged in a steamy cyber affair with her. There is no indication they met in person, though Jamie Connolly would have been prosecuted by Johnson.Though not indicted for that relationship, state prosecutors claimed her allegations catapulted the investigation that pinpointed others.
