The charge states on Feb. 2 that Hertzog possessed two rifle lower receivers and the following ammunition: 125 rounds of 9mm caliber, 145 rounds of 5.56 caliber, two .50-caliber rounds, 214 rounds .45 caliber and 10 20-guage shotgun shells.Hertzog, a former Penn State computer programmer, was sentenced in 2003 to 70 months in prison after pleading guilty to a charge of illegally possession of firearms. The U.S. Third Circuit Court of Appeals affirmed the conviction.
Assistant U.S. Attorney Frederick E. Martin, who is now retired, described Hertzog as a dangerous man with the capability of being a terrorist or providing weapons to organizations. The letter stated in part he would come out of prison “bigger, badder and better” than when he went in.
