Judge Stuart Minkowitz asked the Hanover Township school board and Attorney General's Office to align the policy with N.J.'s Law Against Discrimination.

May 30, 2023.The state attorney general’s office presented the first courtroom arguments Tuesday against the new Hanover Township Board of Education policy that would out LGBTQ students to their parents, urging Morris County Assigning Judge Stuart Minkowitz to continue preventing the policy from being implemented.
Deputy Attorney General James Michael said the new policy takes students who are protected by the state’s Law Against Discrimination and discriminates against them illegally by making their protected status reason for calling parents, while parents of straight and cisgender students would be called only for troubling behavior and concerning conduct.
LGBTQ students might not seek help for fear of being outed, he said, concluding that it’s in the public interest for students to attend schools safely, regardless of their sexual orientation or gender identity or expression. “You name protected classes for particular treatment,” he said. “It would be just as inappropriate to put race or national origin there.”
