The district attorney has opted to not file charges against Glenwood Caverns Adventure Park — and Wongel Estifanos' family are furious., Glenwood DA Jefferson Cheney said his office was unable to prove beyond reasonable doubt that any crime had been committed, after the 6-year-old fell to her death while riding the Haunted Mine Drop in September of last year.
"What a terrible message to send. That in Glenwood Springs someone can recklessly kill a child and not even get a ticket." In October, the family filed a wrongful death lawsuit, one month after a report found that Wongel was not buckled into the safety restraints, and that the operators had manually bypassed the security system that prevented the ride from deploying.
"I am so sorry for their loss and while I understand that my words cannot touch their grief, my heart continues to ache for them," he said."As I have said before, safety is and always has been our top priority. We have always put people – our guests and our team members – above all else." As a built in safety mechanism, every time the ride brings passengers back up, the rods that secure each seatbelt must be taken out and reinserted, to show that the seat has been cycled; if they are not, the computer alerts operators with a"restraint cycled" error, with a red indicator light.
"Operators 1 and 2 returned to the control room, and the HMI screen showed no errors; Operator 2 then dispatched the ride."
