The settlement stems from a Trump administration complaint filed by the Department of Justice in December 2020 that alleged Facebook created a separate hiring process for certain temporary visa holders. Assistant Attorney General Kristen Clarke of the Justice Department’s civil rights division said in a statement that “Facebook is not above the law” and the settlement reflects the need to hold companies accountable to discriminatory hiring practices.
The settlement, including the fine and the financial payment, are the largest civil penalty the civil rights division has ever recovered, according to the DOJ.Justice officials said the initial inquiry into Facebook’s hiring processes occurred after the company filed to hire a foreign worker as an art director, according to. The role reportedly required a bachelor’s degree and two years of experience, and department officials said the company should have been able to find a U.S. worker.
