Ethical guidelines set out by the Canadian Judicial Council specify that judges must cease all partisan political activity.

Elections Canada donations data and information on federally appointed judges and tribunal members analyzed by the IJF and the National Post suggest that possibly two judges and at least 15 tribunal members may have continued to make donations to political parties after being appointed by the Trudeau Liberal government.

While the CJC’s ethical guidelines describe themselves as “aspirational” and “advisory,” Jula Hughes, dean of the law faculty at Lakehead University in Thunder Bay, Ont., explained that the application of the guidelines in practice is much more complex.Article content The second case is a Toronto-based superior court judge appointed in early 2021. The judge’s name matches Elections Canada’s database showing one donation later in 2021 and multiple donations in 2022 to the Conservative Party of Canada and Pierre Poilievre’s leadership campaign. In this case, the addresses on the donations database were not an exact match with the appointment records.

In a subsequent internal email erroneously sent to the Post, she referred to the probe as a “review.”Article content While members of quasi-judicial tribunals are not explicitly prohibited from making political donations, guidelines signed by Prime Minister Justin Trudeau in 2015 call on them to avoid political activities as much as possible.
