Editorial: A surprise win for the Voting Rights Act

Not only was the Voting Rights Act saved, but the decision may restore some of its former powers.

Although the Allen v. Milligan decision is unexpected good news, it shouldn’t be mistaken as a sign of a more enlightened court when it comes to voting rights.For 10 years, the U.S. Supreme Court has inflicted debilitating rulings on the Voting Rights Act of 1965, or VRA, eviscerating the legislation and weakening its power to expand democracy by removing barriers to voting and representation.

But to the surprise of most, not only was the VRA saved but the decision may restore some of its former powers. A three-judge federal panel in Birmingham ruled unanimously that the Legislature should have carved out a second district in which Black voters make up a voting-age majority or “something close to it.”This decision is the one upheld by the Supreme Court in a 5-4 decision in which Chief Justice John Roberts and Justice Brett Kavanaugh joined the three liberal justices: Sonia Sotomayor, Elena Kagan and Ketanji Brown Jackson.
