“So we’ll be looking at them. And we pose the question, how and should they contribute to the attainment of the act? But for other players in the system, we haven’t even gone that far … we’re asking, do they have a material effect on the broadcasting system.” Shortliffe said when it comes to the question of whether the objectives in the Broadcasting Act apply to online services, “in the largest sense, we haven’t determined that yet.”
Because of that revenue threshold, the CRTC expects only a few dozen platforms will fall under the new registration requirements, Shortliffe said. That number includes “two or three” podcast services. Before it became law, many were concerned the Online Streaming Act would put user-generated content, such as user posts on YouTube or TikTok, under the CRTC’s regulatory authority. The Liberal government said it would direct the CRTC not to regulate content made by social media creators, and content that is only available on social media platforms, but that directive hasn’t been finalized yet.
That means large streaming services would be captured. “Netflix is clearly producing programming that is analogous … to traditional broadcasters,” he said.
