Akins’ defense team filed the motion to dismiss after Passaic County rejected a $4 million award in the case. Reached through non-binding arbitration, the award would been split equally between Passaic County and Mitchell, with each party on the hook for $2 million. The judge will consider the motion to dismiss the case at a hearing on March 4 in Bergen County Superior Court.
Akins was on patrol, and bumped into the scene, with Jackson’s Toyota sideways in the middle of the road. In his deposition, Akins said he thought it was a traffic accident. Akins is never seen in the dashboard video during the shooting or in the immediate aftermath. In his deposition, Akins says he saw Jackson tumble out of the car, then began moving his vehicle backwards and to the left to avoid colliding with Jackson’s vehicle as it rolled back.
“I wouldn’t really have a clear shot without jeopardizing the safety of Ms. Jackson and other people,” he said in deposition.
