Cook County settles two medical malpractice claims at Stroger Hospital for nearly $8.6 million

A woman who was 35 weeks pregnant at the time sued for improper treatment after a car crash resulted in an emergency cesarean section and the baby “was unable to be resuscitated.”

The Cook County Board unanimously, and without discussion, approved two medical malpractice settlements related to deaths at the county-run Stroger Hospital. The larger of the two settlements, for $6.75 million, is slated to be paid to Brianna Newman. According to a lawsuit she filed in county court, Newman arrived at Stroger’s emergency room complaining of pain to her abdomen following a car crash and rollover in January 2020.

Written testimony from an unnamed physician that accompanied the lawsuit noted that “fetal heart tones were within normal limits” when Newman showed up at the emergency department. “It is my opinion that had the standard of care been complied with in this matter, that fetal distress would have been diagnosed in a timely fashion and would have resulted in earlier intervention,” and Massiah “likely would have survived neurologically intact.
