that funneled Davis money from Hamilton, at least according to the facts presented at trial.
According to the evidence, Hamilton forked over $6,200 to Caraway after approaching Caraway about a real estate project. And he sent $40,000 Davis’ way while trying to get her support for some state tax credits. Whether these were bribes or “gratuities” matters a great deal to the appeals court because somehow the jury might have gotten confused.
Davis, who chaired the City Council’s housing committee, was the linchpin to getting the full council to agree to support a development Hamilton wanted state tax credits for. He got Davis’ support, thus he got the City Council’s support, thus he was able to make a credible application for the credits.
Meanwhile, the appeals court somehow takes to heart a claim from Hamilton’s attorneys that “Davis intended to withdraw her guilty plea because she only did so out of fear.” The court wrote, “Tragically, however, Davis was killed in a car crash after being hit by a drunk driver, and thus that plan never came to pass.”
