Veronica Cajamarca, 36, said she and the only other bilingual employee of the Erath County Tax Assessor-Collector office were asked to sign the policy after other employees complained they were talking about them in Spanish.

“I have and will continue to work daily to do what I can to make Erath County offices a place where everyone feels comfortable and supported in their professional and personal lives,” he wrote. Then about three weeks ago, another clerk told Cajamarca some of their co-workers had “an issue” with the two bilingual employees speaking Spanish.On the week of Feb. 7, Cajamarca said the Carey asked her to sign a document entitled “English-Only Rule,” which read:

“It really hurt me,” Cajamarca said. “I’ve translated for several people. I’ve done my part for what they pay me for, for this to turn around and be a slap in the face.”David Donatti, staff attorney with the ACLU of Texas, said he believes the rule Cajamarca was asked to sign is illegal, discriminatory and unconstitutional.

“I think certainly terminating someone for speaking a language other than English would violate the 14th amendment,” he said.according to Equal Employment Opportunity Commission guidance – notably when related to safety, cooperative work assignments and performance monitoring. The ban does not make any exceptions for times when employees are on break or when they are speaking to each other about non-work related matters, which are protected under the EEOC.
