Trump ally Steve Bannon has declined to follow a subpoena from a House committee set up to investigate the U.S. Capitol riot on January 6.
If the select committee recommends holding Bannon in contempt of Congress next week, it will set the stage for the entire House of Representatives to vote on it. Lawmakers could then refer him to federal prosecutors for criminal charges, though the DOJ has argued in the past it has discretion to decide whether to pursue criminal action.
White House Press Secretary Jen Psaki declined to weigh in on contempt Thursday, telling reporters it’s “something that is between [the select committee] and the Department of Justice, an independent agency that would make any of those decisions.”The seven Democrats and two Republicans who make up the January 6 committee have subpoenaed a range of Trump allies and administration officials, targeting both the immediate leadup to the Capitol riot and Trump’s efforts to overturn his election loss.
