Walmart’s lack of policies and training around the sale of toy weapons in its stores could be enough for a jury to find the retailer liable for the 2014 death of John Crawford III, the court ruled.
COLUMBUS – A federal appeals court ruled against Walmart and in favor of the family of a Black man who was shot and killed by police in its Beavercreek location while holding a toy assault weapon.from the 6th U.S. Circuit Court of Appeals reverses a lower court’s decision to dismiss the wrongful death lawsuit.
The court reasoned that Walmart had no policies in place to stop customers from picking up unboxed weapons. It didn’t train employees to handle such situations, even though the store knew the faux weapons could easily be mistaken for real weapons.U.S. Judge Alice Batchelder dissented from the decision, arguing that Walmart’s negligence was too indirect a cause of the shooting to warrant liability in the shooting.
“Tell me where he got the gun from,” a detective reportedly said to her repeatedly, based on footage of the interrogation.of the shooting in 2017. Then-U.S. Attorney Benjamin Glassman said in a statement at the time that prosecutors would be unable to meet the legal burden sufficient to bring an indictment.
