Alabama is set to execute Kenneth Eugene Smith tonight for his conviction in the 1988 murder-for-hire of Elizabeth Dorlene Sennett, a Colbert County pastor’s wife. The lethal injection execution is set for 6 p.m. at Holman Correctional Facility. Updates:
Kenneth Smith is on Alabama's Death Row for the killing of Elizabeth Sennett .Alabama is set to execute Kenneth Eugene Smith tonight for his conviction in the 1988 murder-for-hire of Elizabeth Dorlene Sennett, a pastor’s wife from Colbert County who was fatally stabbed and beaten.
“Smith waited until the afternoon of November 17, 2022—his scheduled execution date—to file his emergency motion for a stay of execution,” Huffaker’s ruling states. “This Court noted in that a stay of execution could have been filed in that case more than ten days prior to the scheduled execution...Smith had many earlier opportunities to move for a stay of execution while his federal lawsuit was pending.
“The district court should have allowed Smith to file his proposed amended complaint,” the appeals ruling states. “Thus, the district court erred in denying Smith’s motion for leave to amend his complaint on the ground that amendment would be futile.” The higher court did not issue a stay in the case, meaning the execution was still set for Thursday evening. Smith’s team immediately asked the lower court to issue a stay, and the court held a telephone conference Thursday afternoon. Several hours after the conference, Huffaker ultimately ruled against granting a stay for Smith.
Smith was sentenced to death by an Alabama trial judge despite a jury’s 11-1 vote at his second trial that he be sentenced to life without the possibility of parole. The jury at his first trial had recommended death.Smith was convicted of murdering Elizabeth “Liz” Dorlene Sennett, a mother and grandmother, on March 18, 1988.
